What is Child Support?
Child support is a legal obligation and arrangement that is entered into when a married couple with children separates or divorces. The support is generally paid to the parent with whom the child/children live with most of the time.
The level of child support can usually be decided in mediation without the couple having to appear in court, however if the supporting partner is in breach of their child support obligations, the receiving partner may need to seek out legal advice.
What is Spousal Support?
Spousal support is a legal obligation and arrangement that is entered into when a married couple separate or divorce. It is determined by calculating the assets that the couple have gained together since the date of their marriage and is typically dividing equally. The main exception to this is the matrimonial home which is divided 50/50 regardless of whether it was purchased before or after the couple married.
A spousal support agreement can usually be reached during a mediation although in some cases, arbitration may be necessary.
